READ COMPLETELY BEFORE AGREEING
In consideration of being permitted to participate in any activity at Field 44, including but not limited to sports and athletic programs, practices, games, batting cage use, pitching machines, golf simulators, inflatable attractions, training sessions, events, and parties, the undersigned acknowledges, understands, and agrees as follows:
ASSUMPTION OF RISK
I acknowledge that participation in activities at Field 44 involves inherent risks, including but not limited to:
Being struck by balls, bats, or equipment
Use of pitching machines and automated feeders that deliver balls at high speeds
Slips, trips, or falls on turf or facility surfaces
Equipment malfunction or misuse
Physical contact with other participants
Use of inflatable attractions such as bounce houses and obstacle courses
Falls, collisions, improper landings, overcrowding, or misuse of inflatables
Illness, including communicable diseases
I understand that these risks may result in serious injury, permanent disability, or death. I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of Field 44 or others.
RELEASE OF LIABILITY
I hereby waive, release, and discharge Field 44, its owners, agents, employees, staff, volunteers, and contractors from any and all claims, liabilities, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in any activity at Field 44.
INDEMNIFICATION
I agree to indemnify, defend, and hold harmless Field 44 and its representatives from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising out of my participation or the participation of any guest I bring.
EQUIPMENT USE & FACILITY CONDITIONS
I acknowledge that I may use athletic equipment including pitching machines, batting cages, training tools, inflatable attractions, and golf simulators. I understand improper use of such equipment may result in injury.
I agree to use all equipment responsibly and in accordance with posted rules and instructions.
INFLATABLES & RECREATIONAL EQUIPMENT
I acknowledge that Field 44 provides access to inflatable attractions, including but not limited to bounce houses and obstacle courses.
I understand that use of inflatable equipment involves inherent risks, including but not limited to falls, collisions, improper landings, overcrowding, and injuries caused by other participants.
I agree to follow all posted rules, including age, size, and capacity restrictions.
I acknowledge that adult supervision is required for minors using inflatable equipment, and I accept full responsibility for monitoring any minors under my care.
I voluntarily assume all risks associated with inflatable use and release Field 44 from any and all liability related to such use.
24/7 ACCESS & NO SUPERVISION
I acknowledge that Field 44 may provide access to the facility at times when staff are not present. I understand that I am solely responsible for my safety and the safety of any guests during such times.
GUEST RESPONSIBILITY
I accept full responsibility for any guests I bring into the facility. I agree that all guests are subject to the terms of this waiver, and I assume all liability for their actions and participation.
PROPERTY DAMAGE
I agree to be financially responsible for any damage to Field 44 property, equipment, or facilities caused by my actions or the actions of my guests, whether through negligence or misuse, including damage to inflatable equipment.
CONDUCT
I agree to follow all rules and guidelines established by Field 44. I understand that unsafe or inappropriate behavior may result in removal from the facility without refund.
ALCOHOL DISCLAIMER
If alcohol is consumed on the premises, I acknowledge that it is done at my own risk. Field 44 is not responsible for any injury, damage, or incident resulting from alcohol consumption.
GOVERNING LAW
This agreement shall be governed by the laws of the State of Ohio. Any legal action must be brought within the State of Ohio.
PARENT / GUARDIAN CONSENT FOR MINORS
If the participant is under 18 years of age:
I, the parent or legal guardian of the minor participant, acknowledge that I have read and understand this Waiver and Release of Liability and agree to its terms on behalf of the minor.
I understand and acknowledge the risks described above and consent to the minor’s participation in all activities at Field 44, including but not limited to athletic training, use of pitching machines, inflatable attractions, and all related activities.
I agree to supervise the minor as required and accept full responsibility for the minor’s safety and conduct while at the facility.
I further agree to indemnify and hold harmless Field 44 from any and all claims, liabilities, damages, or expenses arising from the minor’s participation.
I authorize Field 44 to obtain emergency medical treatment for the minor if necessary, and I agree to be responsible for any costs associated with such treatment.
ACKNOWLEDGMENT
BY ACCEPTING THIS WAIVER AND RELEASE OF LIABILITY, I ACKNOWLEDGE THAT I HAVE READ IT, FULLY UNDERSTAND ITS TERMS, AND AGREE TO IT FREELY AND VOLUNTARILY.
